The Walter & Wild Group, being Walter & Wild Holdings Limited and its subsidiaries (Walter & Wild, we or us) recognise the importance of safeguarding your personal and financial information. We respect your right to privacy and your right to view and update the personal information we hold about you and are committed to protecting your privacy when you contact us in any way.
We will deal with your personal information in accordance with the Privacy Act 2020 (Privacy Laws) and this policy. If you are located in the UK or EU, the arrangements set out in the UK and EU Addendum to this policy will also apply to our dealings with your personal information.
Your continued use of our websites provides your unconditional consent to us collecting, storing, using and disclosing your personal information in the manner set out below.
If you choose not to provide us with your personal information, then we may be unable to provide you with some of our products and services, and some functions and features on our websites may not be available to you.
Purpose
The purpose of this policy is to outline the key principles regarding the collection, use, retention, security, and disclosure of personal information at Walter & Wild. Personal information may be held by Walter & Wild about individuals we interact with including but not limited to employees, applicants for roles with us, suppliers, contractors, consumers of our products and visitors to our premises.
Personal Information
Collecting Personal Information
Personal information is any identifiable information about an individual person, such as your name, contact information and purchasing preferences. Personal information might be provided to us by you or by others. The type of personal information we collect and retain depends on the nature of our relationship and our interaction with you. For example, we can collect personal information when you:
use our websites, submit enquiries or use our online forms
purchase products from us, including from one of our websites
contact our Customer Service representatives
communicate and interact with us, including in person, by email, by letter, phone, online or via social media
apply for employment with us
participate in our marketing or promotional campaigns
provide feedback or otherwise communicate with us through our website, by email or social media accounts
visit one of our premises.
Other ways we may collect personal information from you:
We may also need to collect personal information from third parties to assist for example in assessing any claim you may have in relation to one of our products e.g. from a health professional who has treated you, your family or legal guardian, or other sources where necessary to provide a health service.
We may also collect personal information from nominated referees during job applications, or through competitions or promotions operated in conjunction with Walter & Wild by one of our partners.
If you visit one of our premises, we may also collect personal information about you on CCTV as part of our security and crime prevention measures. We may also collect your name and contact details and, where applicable, your vehicle registration through our visitor registration system for security and health and safety purposes, and your visiting history to our premises, and to provide facilities such as Wi-Fi. This information, including CCTV footage may constitute ‘personal information’ as defined in the Privacy Laws.
We collect your personal information where you choose to provide it and at times, by unsolicited disclosure from other parties. If we receive unsolicited information, we consider it unconfirmed, will apply caution, and comply with the principles of this policy and relevant legislation.
In general, you are not required to submit any personal information. We will ask for your permission for certain uses of your personal information, and you can agree to or decline those uses.
Sensitive Information
Some personal information we may collect from you is ‘sensitive information’. The collection of such sensitive information will depend on the nature of our interaction with you and may include information about your medical background for example when dealing with product complaints or product recalls. We may have to collect or exchange such information from and with third parties. If we do, their privacy policies with you shall also apply to that collection and use of your personal information.
We only collect sensitive information where it is reasonably necessary for our functions or activities and either you have explicitly consented, or we are required or authorised by law to do so.
If we hold any sensitive information about you, such information will only be processed and/or disclosed by us for the purpose for which it was provided. If we ask for sensitive information, we will explain the reason for such request prior to or at the time of collection of such information.
As described above, you may decide not to provide us with your personal information we ask for. However, if you do so, or if you provide us with personal information that is inaccurate or incomplete, we may not be able to respond adequately to your enquiries.
Using your Personal Information
We may use your personal information for the purposes of:
communicating with you regarding your product purchases
communicating marketing and research activity
identifying visitors’ and customers’ use of and patterns on our websites to understand service requirements, mapping journeys and improving visitors’ and customers’ needs
presenting advertising and information that is most relevant to you and your interests
analysis in aggregate form (identifiable characteristics removed so that you will remain anonymous)
enforcing our contractual rights
complying with our financial, regulatory and other legal obligations; and/or
any other purpose which is stated to you at the time of collection or that you otherwise authorise.
In all circumstances, we will take all reasonable steps to ensure that our use of your personal information with all application New Zealand laws.

Accessing or Changing Your Personal Information
You have the right to access and correct any personal information we hold about you at any time.
We may require you to verify your identity so that we can ensure your personal information is disclosed only to you and specify what personal information you want access to. We will respond to your request within 30 days.

Disclosing Your Personal Information
The information you provide to us may be shared with third-party providers to the extent necessary to carry out our professional and business needs, to complete your requests, where we are required to disclose that information by law or for safety reasons, or where we have obtained your authorisation.
We will not sell your personal information to any third parties or transfer your personal information to any third parties for their direct marketing use unless you agree to this in writing.
Security & Retention of Information
We have procedures in place to secure and protect personal information from loss, unauthorised access, use, modification, disclosure or misuse.
Despite our best efforts, security cannot be guaranteed against all threats.
To the best of our ability, access to your personal information is limited to those who need to know. Those individuals who have access to the data are required to maintain the confidentiality of the information.
We also make reasonable efforts to retain personal information only for:
so long as the information is necessary to comply with an individual’s request;
as necessary to comply with legal, regulatory, internal business and policy requirements.
The period for which the information is retained will depend on the specific nature and circumstances under which the information was collected.
Data Breaches
Privacy Laws require us to notify the New Zealand Privacy Commissioner about ‘notifiable privacy breaches’ and may require us to notify you. A notifiable privacy breach occurs when the following criteria are met in relation to personal information held by us:
there is: (i) unauthorised or accidental access to that information; or (ii) disclosure, alteration, loss, or destruction of that information; or (iii) an action that prevents us from accessing that information on either a temporary or permanent basis (privacy breach); and
it is reasonable to believe the privacy breach has caused serious harm to an affected individual or individuals or is likely to do so.
If it is not clear whether a suspected privacy breach meets these criteria, we will investigate and assess the breach to determine whether the breach is a ‘notifiable privacy breach’ that requires us to notify the affected individuals. This is to ensure that, subject to Privacy Laws, you are notified if your personal information is involved in a privacy breach that has caused or is likely to cause serious harm. Even if the criteria are not met, we may decide it appropriate to notify you anyway as part of our commitment to taking privacy seriously.
Complaints
We are committed to dealing quickly and appropriately with any privacy complaints.

UK and EU Addendum to Privacy Policy
Walter & Wild is responsible for the processing of your personal information and is the data controller when processing such information. We will deal with your personal information in accordance with the General Data Protection Regulation.
Lawful bases for collection and use of personal information
Our lawful bases for collecting and using your personal information, including for providing goods and services, marketing purposes, dealing with queries, complaints and claims, recruitment purposes, security, health and safety purposes, sharing with our group entities, are:
• Consent – we have your permission after providing you with all relevant information. All of your data protection rights (except the right to object) may apply. You have the right to withdraw your consent at any time.
• Contract – we have to collect or use your information to enable us to enter into or carry out a contract with you.
• Legal obligation – we may collect or use your personal information to fulfil our legal obligations.
• Legitimate interests – we collect or use your information as it benefits you, us or someone else, without causing an undue risk of harm to anyone. All of your data protection rights (except the right to portability) may apply.
We may transfer or process your personal information outside of the UK and EU, in particular, to or in New Zealand in connection with our group operations, and through use of third-party services such as online marketplaces, payment platforms and cloud computing services. Insofar as we transfer or process personal data outside of the UK or EU, this is done pursuant to adequacy regulations or with appropriate safeguards, such that adequate data and/or contractual protections exist.
Your data protection rights
• Right of access – you have the right to ask us for copies of your personal information. You can request other information, such as where we get personal information from and who we share it with, subject to exemptions that may mean you do not receive all the information requested.
• Right to rectify – you have the right to ask us to correct or delete personal information you think is inaccurate or incomplete.
• Right to erasure – you have the right to ask us to delete your personal information.
• Right to restrict processing – you have the right to ask us to limit how we can use your personal information.
• Right to object – you have the right to object to the processing of your personal data.

Data breach
